Acceptance of Terms

These Terms of Service ("Terms") govern your use of Vizzly, a visual testing and review platform operated by Stubborn Mule Software LLC ("Company," "we," "our," or "us"). By accessing or using the Service, you agree to these Terms.

If you use Vizzly on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.

Description of Service

Vizzly helps teams review visual changes by uploading screenshots, comparing them against approved baselines, preserving comments and review decisions, and sharing visual review history across teams, pull requests, APIs, SDKs, CLIs, and coding-agent workflows.

Depending on your plan and settings, the Service may include GitHub checks, preview hosting, public screenshots or properties, public projects, usage analytics, and related documentation.

User Accounts

Account Creation

Some features require an account. You agree to:

  • Provide accurate and complete account information
  • Maintain the security of passwords, passkeys, OAuth accounts, and API tokens
  • Promptly update account, billing, and organization information as needed
  • Accept responsibility for activity under your account and organization
  • Use Vizzly only with content and integrations you are authorized to access

Account Suspension

We may suspend or terminate access if you violate these Terms, create security risk, fail to pay fees when due, exceed or bypass plan limits, or use the Service in a way that could harm Vizzly, other users, or third parties. We will try to provide notice when practical, but urgent security or abuse situations may require immediate action.

API, CLI, and SDK Usage

Vizzly provides APIs, CLI tools, SDKs, and automation surfaces for visual testing and review workflows. By using them, you agree to:

  • Keep API tokens and account credentials confidential
  • Use tokens only for organizations, projects, and workflows you control
  • Respect plan limits, storage quotas, concurrency limits, and feature gates
  • Use reasonable retry behavior and avoid abusive or disruptive request patterns
  • Report suspected token compromise or unauthorized use promptly

We may revoke tokens, throttle requests, reject uploads, or limit processing to protect the Service, enforce quotas, or address abuse.

Third-Party Integrations

GitHub Integration

When you connect GitHub repositories to Vizzly, you authorize us to access the repository, branch, commit, pull request, check run, installation, and webhook data needed to provide the integration. We may create check runs, status updates, comments, and links on your behalf according to your configuration. You can revoke access through GitHub or supported Vizzly settings.

Google Authentication

If you sign in or link an account with Google, you authorize Vizzly to use the Google account information and tokens needed for that authentication or linking flow. You can revoke Google access through your Google account settings.

Payment Processing

Paid subscriptions are processed by Stripe. By subscribing to a paid plan, you agree to provide accurate billing information and authorize recurring charges according to the selected plan. We receive transaction and subscription metadata, but Stripe handles full payment card details.

File Storage and Preview Hosting

Screenshots, diffs, preview files, generated images, and related metadata may be stored with Cloudflare R2 or compatible cloud storage services. For supported uploads, Vizzly validates file types, paths, size limits, compression limits, and metadata before accepting files. You remain responsible for the legality, safety, and rights in the content you upload.

Preview links, public projects, public screenshot properties, and public screenshots may make selected content visible outside your organization when those features are enabled or shared.

Subscription Plans and Feature Access

Feature access, limits, storage, retention, and concurrency depend on your current plan. Current public plan limits include:

  • Free: 3 team members, 1 private project, unlimited public projects, 10GB storage, 30-day retention, and 1 concurrent worker
  • Open Source: public projects only, 10 team members, 75GB storage, 90-day retention, and 6 concurrent workers
  • Starter: 10 team members, unlimited private projects, 75GB storage, 90-day retention, and 6 concurrent workers
  • Team: 50 team members, unlimited private projects, 250GB storage, 365-day retention, and 12 concurrent workers
  • Enterprise: custom limits, retention, and features by agreement

GitHub integration is available across plans. Preview hosting, storage, retention, build capacity, and support vary by plan.

Quota Enforcement

When plan limits are reached or a feature is not included:

  • New uploads may be blocked until storage is freed or the plan is upgraded
  • Additional team invitations may be prevented
  • Build processing may be queued, limited, or rejected
  • Feature controls may be hidden, disabled, or return an upgrade message
  • You may receive in-product notices about quota usage and upgrade options

Plan Changes

Upgrades may take effect immediately with prorated billing. Downgrades generally take effect at the end of the current billing period unless otherwise stated. If a downgrade or plan change leaves an organization above the new limits, existing assets are not automatically deleted solely because of that overage, but new activity may be limited and retention cleanup may remove assets that fall outside the new plan's retention window.

Acceptable Use

You agree not to use the Service to:

  • Violate applicable law or third-party rights
  • Upload content you do not have permission to process or share
  • Upload malicious code, viruses, malware, or intentionally harmful files
  • Upload secrets, passwords, API keys, payment card data, or unnecessary sensitive data
  • Attempt to gain unauthorized access to systems, accounts, organizations, or data
  • Interfere with, disrupt, overload, scan, or abuse the Service
  • Bypass rate limits, storage limits, feature gates, authentication, or access controls
  • Share account credentials or API tokens publicly or with unauthorized users
  • Impersonate another person or misrepresent your affiliation
  • Resell, sublicense, or provide Vizzly as a competing managed service without permission

Subscription and Billing

Subscription Plans

Subscription fees are charged in advance on a recurring basis unless a separate written agreement says otherwise. You are responsible for taxes, usage charges, and fees associated with your selected plan.

Cancellation and Refunds

You may cancel your subscription at any time. Cancellations generally take effect at the end of the current billing period. We do not provide refunds for partial periods except as required by law or expressly agreed in writing.

Content and Data

Your Content

You retain ownership of content you upload or submit to Vizzly. You grant us a limited license to host, store, copy, process, transmit, display, analyze, and create derived review artifacts from that content solely to provide, secure, support, and improve the Service.

Public and Shared Content

You are responsible for your project visibility, preview links, public screenshot properties, and other sharing settings. Content configured as public or shared may be accessible to people outside your organization.

Data Access and Export

You may access and download available project, build, screenshot, and review data through supported product surfaces, APIs, SDKs, and direct file links where available. For broader account, organization, or privacy-related export requests, contact privacy@vizzly.dev or support.

Content Restrictions

You are responsible for making sure your content does not violate third-party rights, privacy obligations, contracts, or law. Do not upload content containing personal information, confidential information, secrets, or regulated data unless you have all required rights and safeguards.

Intellectual Property

Vizzly, including its software, design, branding, workflows, documentation, and service content, is protected by intellectual property laws. These Terms do not grant you any ownership in Vizzly or our intellectual property.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, completely secure, or suitable for every use case.

Limitation of Liability

To the fullest extent permitted by law, Stubborn Mule Software LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities arising from or related to your use of the Service.

Indemnification

You agree to indemnify and hold harmless Stubborn Mule Software LLC from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use of the Service, your integrations, your violation of these Terms, or your violation of law or third-party rights.

Changes to Terms

We may modify these Terms from time to time. We will post updated Terms and update the effective date. If changes materially affect your rights or obligations, we will use reasonable efforts to provide additional notice.

Governing Law

Unless a separate written agreement says otherwise, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Courts or dispute forums with authority in Texas will have authority over disputes related to these Terms, except where applicable law requires a different venue.
